What is UK GDPR?

The UK GDPR is the assimilated law version of the General Data Protection Regulation ((EU) 2016/679) (EU GDPR) as it forms part of the law of England and Wales, Scotland, and Northern Ireland by virtue of section 3 of the European Union (Withdrawal) Act 2018. It has been further amended and modernised by the Data (Use and Access) Act 2025. It is defined in section 3(10) of the Data Protection Act 2018 (DPA 2018), as supplemented by section 205(4) and subsequent amendments.

The UK GDPR aims to empower UK citizens with control over their personal data and to reshape how organisations worldwide approach data privacy.

Data Controller

A controller determines the purposes and means of processing personal data.

Data Processor

A processor is responsible for processing personal data on behalf of a controller.

Data Subject

A natural person to whom the personal data relates.

Data Protection Legislation

Means the data protection legislation enforced in the UK from time to time and includes the Data Protection Act 2018 (as amended) and the UK General Data Protection Regulation (UK GDPR).

Processing

Means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure, or destruction.

Third Party

Means a natural or legal person, public authority, agency, or body other than the data subject, controller, processor, and persons who, under the direct authority of the controller or processor, are authorised to process personal data.

Categories of Data

  • Personal Data: The UK GDPR applies to ‘personal data’ meaning any information relating to an identifiable person who can be directly or indirectly identified, in particular by reference to an identifier (as explained in Article 6 of UK GDPR). Examples include name, passport number, home address, or private email address. Online identifiers include IP addresses and cookies.
  • Special Categories of Personal Data: The UK GDPR refers to sensitive personal data as ‘special categories of personal data’ (as explained in Article 9 of UK GDPR). The special categories specifically include genetic data, and biometric data where processed to uniquely identify an individual. Other examples include racial and ethnic origin, sexual orientation, health data, trade union membership, political opinions, religious or philosophical beliefs.

Standards, Certifications, and Identity

Levett Consultancy undertakes regular audits, maintains certifications, and provides industry-standard contractual protections. We are registered with the Information Commissioner's Office and have obtained the UK Government Cyber Security Essentials certification.

  • The Data Controller: Levett Consultancy is a Data Controller and is committed to protecting the rights of individuals in line with the Data Protection Act 2018 (DPA) and the UK General Data Protection Regulation (UK GDPR).

What Information Do We Collect About You?

Information from the customer is required by us to be able to deliver your contracted services. Where personal data as defined within the UK GDPR guidance is required by Levett Consultancy to deliver a contracted service, you will be asked for your consent. At any point, you can withdraw your consent and any data obtained by the company will be deleted securely.

We process the following explicit categories of your data to deliver contracted services:

  • Name
  • Email address provided by the person receiving contracted services

We obtain your personal data as part of delivering contracted services via our central service desk platform or through receiving email communication to our internal systems.

Legal Basis for Processing

Under Personal Data (Article 6 of UK GDPR), our lawful basis for processing your general personal data is that it is necessary for the performance of a contract with the data subject to deliver services purchased as defined within the relevant support services description. We require your personal data as it is a contractual requirement necessary to deliver our purchased services to your organisation.

In addition to this, we may use the information for one or more of the following purposes:

  • To provide information to you that you request from us relating to our services.
  • To provide information to you relating to other services of interest to you.
  • To inform you of any changes to our services.

Data Sharing and Retention

  • Sharing Personal Data: Your personal data will be treated as strictly confidential, and will be shared only with our contracted supply chain to enable us to deliver contracted services.
  • How Long Information is Held: We retain your data for no longer than is necessary as stated in your service contract. What is necessary will depend on the circumstances of each case, taking into account the reasons how that data was obtained.

Your Rights and Your Personal Data

Unless subject to an exemption under the UK GDPR, you have the following rights with respect to your personal data:

  • The right to request a copy of the personal data which we hold about you.
  • The right to request that we correct any personal data if it is found to be inaccurate or out of date.
  • The right to request your personal data is erased where it is no longer necessary to retain such data.
  • The right to withdraw your consent to the processing at any time, where consent was your lawful basis for processing the data.
  • The right to request that we provide you with your personal data and, where possible, to transmit that data directly to another data controller (known as the right to data portability), where applicable.
  • The right, where there is a dispute in relation to the accuracy or processing of your personal data, to request a restriction is placed on further processing.
  • The right to object to the processing of personal data, where applicable (i.e. where processing is based on legitimate interests, direct marketing, or processing for the purposes of scientific/historical research and statistics).

Security of Your Information

The systems we use to store data are certified to ISO 27001 (Information Security Management), ISO 27017 (Cloud Security), and ISO 27018 (Cloud Privacy). All company staff are trained and fully aware of data protection. Levett Consultancy systems and security are tested and audited annually to achieve Cyber Essentials PLUS certification.

Our Supply Chain

To ensure the security of your data and compliance with the UK GDPR, we have implemented a robust supplier management program:

  • Contractual Agreements: Every supplier we work with is bound by a contract that explicitly mandates their adherence to UK GDPR standards. This includes provisions for data processing, security measures, and breach notification protocols.
  • Annual Reviews: Each supplier undergoes a comprehensive annual review where they must demonstrate their ongoing commitment to data protection. This involves providing evidence of their internal data handling procedures, security measures, employee training programs, and subcontractor compliance.
  • Ongoing Monitoring: We maintain an active approach to supplier relationships, regularly assessing their performance and staying informed about any changes in their operations.
  • Consequences of Non-Compliance: Suppliers who fail to meet our stringent data protection standards or demonstrate ongoing commitment to UK GDPR compliance will be removed from our supply chain.

Specialised Compliance Areas

  • International Data Transfers: The UK GDPR imposes restrictions on the transfer of personal data outside the UK, to third countries or international organisations. Levett Consultancy does not transfer personal data outside the UK unless an international organisation or third country complies with Chapter V of the UK GDPR.
  • Automated Decision Making: We do not use any form of automated decision-making in our business.
  • Further Processing: If we wish to use your personal data for a new purpose, not covered by this Data Privacy Notice, then we will provide you with a new notice explaining this new use prior to commencing the processing and setting out the relevant purposes and processing conditions.
  • Policy Changes: Any changes we may make to our compliance and privacy policy in the future will be posted on this page and, where appropriate, notified to you by email.
